Attorney seeks charges against Buffalo Police in dog ‘shooting spree’

The Buffalo Police Department reported their Narcotics Division executed a series of search warrants during the week of July 25-29, arresting several individuals and announcing they seized small quantities of drugs, mostly marijuana.

What they did not report was the number of dogs killed while executing their raids. On Thursday, July 28, Cory Meer, 23, of Esser Street saw police raid his home, handcuff him and place him on the floor face down.

According to Meer’s lawyer, Matthew Albert, Meer’s two-year-old son and the family dog, Damian, a six-year old tan Pit Bull watched helplessly.

Meer claims Damian, although a pit bull, was not a threat to the officers.

“He is the most family friendly dog I’ve ever had… he’s never hurt anyone,” said Meer. “He would have licked the cops.”

As Meer was handcuffed and lying face down, Meer claims he begged police not to shoot his dog.

Instead, police shot Damian multiple times as Meer’s two-year old son watched.

“My son lost his best friend right in front of him,” Meer said.

Unluckily for police, Meer was not charged with any crime, though someone in the house allegedly had a small amount of marijuana which, perhaps, made the raid worthwhile.

About 12 hours after Damian was killed, Michael Urban of Weaver Street was cooking breakfast, his dog, Gotham, a male, one and a half year old blue nose pit bull, black in color, stood next to his owner.

As police stormed the home, Urban and Gotham stood still. The dog gazed “politely” at police, about 10 feet from the door and made no threatening gestures.

Police, standing at the doorway, police took aim but not very good aim. They shot Gotham, but not fatally, and poor Gotham, frightened, crying and in mortal fear hid behind his owner.

That was a futile gesture as police moved in on the frightened dog and taking better aim shot downward. This time the bullet went clean through Gotham’s head which caused the poor dog’s brains to explode and spread all over the apartment.

The bullet used to kill Gotham almost took a second life as it went through the floor, narrowly missing the tenant in the downstairs apartment, Jami Krafchak, who was just waking up, but almost didn’t.

After killing his dog, police did not arrest Urban. Upon further investigation, it appears the reason they did not arrest Urban is that they had the wrong house.

No one at Urban’s home matched the descriptions of the targets of the search warrant, who it appears, live at another home down the street.

Police might be fairly excused for this faux pas since the home they should have raided and killed dogs and narrowly missed bystanders, which was right down the street, does look similar to Urban’s house.

After killing Urban’s dog and sending a bullet through the ceiling, police rushed downstairs and found Ms. Krafchak in bedroom attire and more than a little startled.

They quickly searched or rather manhandled the woman and searched her apartment.

Neither Urban or Krafchak were charged with a crime.

Happily, the dog killing search of what seems to be the wrong house, did lead to one arrest – a roommate of Urban’s had a minute portion of marijuana on his person. 

        Meer and Urban have retained Albert to try and obtain justice for the slayings of their dogs.

mattalbertAlbert said their cases are not unique. He has 12 active cases of dogs being killed by the Buffalo Police Department Narcotics Squad.

“They are going to say they are going after dangerous drug dealers,” Morris said. “Out of the cases I have, they’ve hit the wrong houses numerous times, found nothing numerous times, and I think at best, they’ve found a few pills at one of these houses… charges I got dismissed because they were filed wrong.”

Albert added he will not only file lawsuits, but plans to pursue criminal charges against the police who killed the two dogs.

Acting Erie County District Attorney Michael Flaherty held a press conference last week where he said, “We will go after whoever abuses any defenseless creature in our community.”
     Albert said, “We will make sure Mr. Flaherty has full cooperation so that he can fulfill his promise to the Western New York community…  And if he can ignore the politics of  going after a police officer for crimes they have always gotten free passes on, then maybe he does deserve to be the next DA of Erie County.”

The police officers involved were unavailable for comment.

When questioned privately, an officer who regularly raids home in search of narcotics, said that it is matter of policy to shoot pit bulls first and not try to find out if they are harmless or aggressive.

  • This statement is exactly why breed specific legislation does not work. The dog has very clear and identifiable markings that are common in rottweilers and the body shape and lack of a long tail, show that it is not a pitbull. I guess when in doubt, call it a pitbull and condemn it…

  • Btw, the photo at top of article isn’t right, that’s a different case (Los Angeles) and is a rottweiler who was also gunned down simply for existing and being “owned” by a man who didn’t protect him. The man left the dog in his car to go film and ask questions of the police who had barricaded a neighborhood due to some suspected crime. The loyal dog saw the cops moving in on his loved one and jumped out the open window and was gunned down for attempting to shield his person from harm. This was a couple of years ago, I saw it unfold live on tv…horrifying.

  • They are awesome, brilliant dogs. I’ve rescued quite a few, and am impressed. It hurts to know that some departments are now adding pit bulls to their K9 units. Now, they will endure the same torture that their German shepherd and Belgian Malinois cousins are going through, at the hands of these monsters.

  • So true. When the members of the K9 team at my department found out I was an advocate for animals, they thought it would be good fun to brag about what they do to their K9’s in front of me. When I chose to ignore them, the lead K9 “trainer” brought his dog into the station and hanged him to unconsciousness in front of the civilian night crew, including me, to send the message: “Try and stop me.” This torture is standard procedure in the vast majority (if not all) of K9 units, and they jokingly named ours “The Hang ‘Em High Club.” http://www.stoplynching.com

  • EVERYONE should see how police and sheriffs and military treat their own K9’s behind the scenes. It is the opposite of what they tell you via their kiss-ass mainstream media sources.   • I thought cops had to pass some kind of an IQ test. These numbskulls must have had the answers fed to them beforehand. Are they incapable of making sure they have the correct address before entering a property with their guns blazing? Can they even read a warrant? Or don’t they give a damn? Incidents like this are textbook examples of violation of people’s Fourth Amendment rights against illegal seizure and destruction of private property. Sue their azzes. Where the hell is the ACLU in these cases? I thought they were supposed to stand up and protect our constitutional rights. They don’t seem much interested in protecting the rights of a two year old child to be safe and secure in his own home. Or the rights of a woman to be safe and secure in her own bedroom. But then only dogs died here. They were completely innocent of any crime, but they were just dogs. They have no rights.

Officials in the police dept. have already made this a policy,It’s already in place the “Incident” happened because of that policy. So apparently Police have already evaluated the situation and made the choice to equal –kill pit bulls on site. I know many decent and kind Buffalo Police Officers. I have to wonder if this is policy would these men be reprimanded if they chose not to shoot? In my OP I realize I blanketed all Officers, I realize that is Incorrect of me to do. I am not anti-police….I am anti-animal murder.

  • These cowards take pride in taking away any humanity the dog owner may have. The officers live to see the citizen in pain and what worse pain then for the pet owner to see his small child forced to witness the murder. All the time the owner pleaded for these thugs not to shoot and kill his dog. Which i am sure prompted them to want even more to murder the pet. I personally will not allow any thug murderer to arbitrarily murder anymore of my family members. (Notice i did not threaten officers unless they think they are thug murderers). I know many who feel the same. Oh I know we will hear how we are not giving respect to the officers poor things. I will hear how it shouldn’t reflect on other officers. Although in any group when a member breaks the rules. He reflects his crime on the rest of the members. The police should be no different. As long as these officers thumb there noses at the people that pay there salary and not take dog training classes. In most cases for free. Not attending training will make any shooting by police no excuse. I am tired of these cowards that feel so strong and brave shooting defenseless pups. I am more tired of their bosses allowing this with a reason that makes it okay to murder dogs so vague in process and guidelines.

  • Shoot first and try NOT to find out if they are aggressive?? is this real? who the hell does police work in this way? and they want community respect? This is heartbreaking and unbelievable. and who, made this a “policy”? I cannot believe after reading about other officers taking the time to properly allow owners to restrain,remove,and put their dogs out of site in other areas of the state, that Buffalo police have claimed this as a policy. Without regret.

    Not only does their Ignorance and lack of knowledge about this, or quite obviously any breed of dog, show itself to the point of embarrassment, but it leaves no questions to be asked about the backwards,atrocious, and kill friendly policies of the B.P.D. concerning animals.

    I see NO POINT in such a rule except to allow them to gleefully kill dogs in front of horrified owners–and in this case –in the wrong house, allowing them to get their “job” done faster–(picking up small amounts of marijuana?), and leaving a sweet, friendly, animal dead and a grieving family behind all because of the Idiocy,Ignorance and frightening lack of compassion on BP officers part.

    I will not,even as one person, watch this policy continue without crossing all avenues for change. This will not only go as viral as I can make it fly, but I will do all I can to make sure the BPD are left with the same stain they left behind when killing obedient,friendly, family pets, because of a perceived and highly incorrect notion of breed discrimination. I am sad, disgusted and ashamed, It’s too bad The Buffalo Police don’t feel the same about the animal murdering they do.

  • Good luck with that MA. Hard to get anywhere when you slam the Mayor, DA, Police, Animal Shelters, Rescues, and anyone else that ever followed you and woke up! Disappointed in the Art Voice really. Of course, this is only one opinion! My advise to anyone following this pos…RUN AWAY! Just because there are no Cyber Bullying Laws does not make this person Right! Stop buying the bs…now as far as police shooting animals, If, the Police Officials look into this issue and train properly less incidences will occur. My question is… how necessary is it to bust down doors for drug cases? I am seeing countless people and animals shot and killed over and over again. So many are wrong homes. Are Raids the only way to handle these issues? I ask all Police to evaluate what is really going on and why it continues to happen. If, they do…there is no reason for this type of post! The issue will be resolved with less people and animals hurt injured or killed. No need for the rest! I plea to Police Officials to evaluate Raids of this nature. I have faith in our BLUE! Thanks!
