In my opinion, on FEBRUARY 15, 2019, the President should declare a National Emergency at our Southern Border and by Proclamation enact the Immigration and Naturalization Act of 1952 directing that the Southern Border be immediately closed to all individuals who do not enjoy a legal, existing reason for entry into the United States. He should order the immediate construction of physical barriers on the Border in order to facilitate the implementation and enforcement of the 1952 Act. The physical barriers should be constructed along the length of border deemed necessary by the President and along the areas designated by the President with the priority designated by the President.
The authority to enact and enforce the 1952 Immigration and Naturalization Act is contained in Section 212(f), which states:
“Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate”…
That seems pretty self explanatory to me along with all the Supreme Court Decisions.
The President should direct that any attempts by any court orders from any Federal Judge(s) to interfere with the Presidential Proclamation, be disregarded, as the specific intent of the Act by Congress was to provide the President the authority and the ability to protect the American Citizens in times of urgency without having to endure cumbersome Judicial Proceedings, thereby endangering the Security of the United States. He should use this opportunity to complete construction of these barriers for wherever the Border Patrol needs them… be it 500 miles or 1500 miles!! Get it done once and for all! Increase the Defense Budget for the funds and/or take them from any Democrat programs from which you can.
The Supreme Court has Ruled/Declared several times that the President and not any Judicial Jurisdiction has Plenary Power on Immigration matters.
