Indemnification, Waiver and Release
Event: Mardi Gras Fat Tuesday Parade - March 4, 2014
The registered party desires to participate in the above-mentioned event (the "Event"), which is sponsored by the above-mentioned sponsors. The registered party understands that his or her right to participate in the Event is conditioned, in part, upon his or her execution of this Indemnification, Waiver and Release.
In consideration of the registered party's right to participate in the Event, and intending to be legally bound hereby, the registered party, for himself or herself and his or her heirs, personal representatives and assigns, hereby voluntarily and knowingly, completely and forever releases, waives and discharges ARTVOICE, other sponsors, promotional partners, and advertising agencies involved with the Event, and each such party's respective affiliates, parents, subsidiaries, shareholders, directors, officers, agents, employees, consultants and representatives (collectively, the "Indemnified and Released Parties"), from any and all claims, actions, costs, losses, expenses, demands, damages, and/or other liabilities, known or unknown, absolute or contingent, and whether or not fixed, and whether in contract or in tort or under any federal, state or local statute, ordinance or regulation, which the registered party ever had, now has or might in the future have against any of the Indemnified and Released Parties, resulting in any manner from and/or by reason of the for personal and emotional injuries, claims for attorneys' fees and costs, claims for liquidated damages, compensatory, general and punitive damages, and every other kind of relief available at law or in equity, whether accrued now or hereafter.
The registered party hereby represents, warrants and covenants that: (a) he or she is at least twenty-one (21) years of age; (b) he or she is not employed by any of the Indemnified and Released Parties, and is not related by blood to anyone employed by any of the Indemnified and Released Parties; (c) he or she is in good physical condition and does not suffer from any conditions that will make it dangerous, hazardous, or harmful for him or her to participate in the Event; (d) he or she understands that his or her participation in the Event: (i) has inherent risks, dangers and hazards; and (ii) may result in injury or illness including, but not limited to, bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other ailments that could cause serious disability; and (e) he or she understands that the event consists of: (1) operating a motor vehicle in the Mardi Gras Fat Tuesday Parade, (2) following vehicles along the parade route, (3) walking next to, in front of, or behind a float, (4) sitting or standing on a float.
Participants in Mardi Gras Fat Tuesday Parade do so at his or her own risk, and hereby expressly assumes any and all risks and dangers that may result therefrom. The registered party hereby expressly assumes: (f) all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the conduct or omission of any of the Indemnified and Released Parties; (g) any and all risk of physical injury or death resulting from or in any way related to his or her participation in the Event; and (h) the risk of any loss of, or damage to, any of his or her property that may occur as a result of the registered party's participation in the Event.
The registered party hereby agrees to protect, indemnify, hold harmless, and defend the Indemnified and Released Parties, from and against any and all claims, actions, costs, losses, expenses, demands, damages, and other liabilities of any nature whatsoever (including, but not limited to, the costs and expenses of experts, consultants and attorneys) arising out of or relating to the registered party's participation in the Event. The registered party's duty to protect, indemnify, hold harmless, and defend the Indemnified and Released Parties shall survive the duration of the registered party's participation in the Event.
The registered party hereby grants to ARTVOICE express permission to use his or her name, picture, likeness, and/or voice in any manner for any advertising or promotion for Artvoice, whether broadcast, published, or used in other medium, and to maintain such name, picture, likeness, and/or voice in a database for future use, all without remuneration, all to the fullest extent permitted by applicable law.
The registered party hereby represents, warrants and covenants that: (i) he or she has fully read and understands each provision of this Indemnification, Waiver and Release; (ii) he or she has been given a sufficient and reasonable time to consider it; (iii) no oral representations, statements, or inducements apart from those set forth in this Indemnification, Waiver and Release have been made by the Indemnified and Released Parties; and (iv) he or she has relied upon his or her own advice or the advice of his or her own attorney in connection with his or her execution of this Indemnification, Waiver and Release.
ALL PARADE PARTICIPANTS (the registered party), including Krewe captains and ANY riders in or on the parade vehicles agree to this waiver by the registered party clicking "I agree". You may not register or participate without agreeing to the terms of this waiver.
What is a Krewe?
Krewes are a big part of Mardi Gras tradition in New Orleans.
The Krewes are the groups of people who create the elaborate floats for the Mardi Gras parades. Traditionally, membership in the Krewe were passed on from generation to generation, and represent some of the elite members of New Orleans society.
Aside from creating floats and wonderful costumes, the Krewes also threw elaborate parties throughout the "Carnival" season which lasts from after Christmas to Fat Tuesday. The oldest Krewe dates back to 1857... the Mystick Krewe of Comus.
