The rock band SoleTurn, featuring the new and re-imagined hits they famously deliver, will be on stage Friday night at Angry Buffalo, 2753 Wehrle Dr., Williamsville, from 7 to 10 p.m., outside if weather permits, inside if not.

In addition to their usual menu of crowd-pleasing new and old songs featuring their own special touch, vocal leader Vik Bhargava said SoleTurn will also play a few choice songs from the Oasis album that is currently the buzz in the music crowd everywhere as the famous English rock band has caught fire again.

Oasis Will Be Returning to the Stage for a Reunion Tour Next Year

“They are a great group and they are together again, so it is our pleasure to do a few of their songs as part of our show Friday night at Angry Buffalo, a wonderful venue for us to perform for our fans,” said Bhargava who along with vocalist and bass player Zachary Michael lead SoleTurn which kicked off the season last March with a sold-out show at the legendary Sportsmen’s Tavern and have been going strong ever since.

that Lie and the Search Warrants It Helped Produce Are Now the Subject of a Franks Hearing Set for March 5 2026 Before Us District Judge Yvonne Gonzalez Rogers if the Defense Prevails the Evidence Seized in the June 2024 Raids Raids That Ended a Mayors Career and Produced a 31 page Indictment Could Be Thrown Out

according to the Defense Motion Filed by David Trung Duongs Attorneys at Jones Day and Swanson Mcnamara Llp docket 119 Special Agent Haunolds June 2024 Affidavit Told the Following Story About the Shooting

on the Night of June 9 2024 Co conspirator 1 the Governments Name for Mario Juarez Was the Target of a suspected Targeted Shooting Due to His Cooperation in This Investigation

the Affidavit Stated That the Assailants Were waiting for Co conspirator 1 to Return Home and May Have Attempted to Draw Him out of His Home Before They Opened Fire According to the Affidavit Co conspirator 1 Only returned Fire

agent Haunold Told the Magistrate He Believed the Shooting Was Targeted and May Have Been Coordinated by the Duong Family in an Attempt to Kill or Harm Co conspirator 1 to Prevent Him from Cooperating with the Investigation

this Was Not Filler This Was Not Background the Affidavit Explicitly Asserted Probable Cause to Believe That Andy and David Duong Had Violated 18 Usc 1512a the Federal Witness tampering Statute That Applies when a Defendant killed or Attempted to Kill Another Person with Intent to Prevent the Attendance or Testimony of Any Person in an Official Proceeding

this Was a Claim of Attempted Murder It Was Presented to a Magistrate Judge As Grounds to Raid the Homes of a Sitting Mayor a Vietnamese american Businessman His Son and Their Offices

what the Evidence Actually Showed

the Defenses Supporting Declaration docket 120 Filed by Attorney Neal J Stephens and Containing 23 Exhibits Paints a Radically Different Picture One Drawn Entirely from Evidence the Fbi Already Had

here is What Investigators Knew Before Agent Haunold Submitted His Affidavit on June 14 2024

juarez Told Oakland Police He Fired His 40 Caliber Handgun

jaurezs Son Told Officers He Heard Four Initial Shots Coming from the Front of the House Where Juarez Was Standing

a Neighbor Independently Confirmed Hearing Four Initial Shots

officers Recovered Four 40 Caliber Shell Casings in Juarezs Front Yard

juarez Had Told Police the Sequence Went Like This Unknown Assailants Fired Twice at Him He Fired Four Times in Self defense and the Assailants Left and Returned Approximately Ten Minutes Later to Fire Again

but the Physical Evidence Said Something Else Four Shots Were Heard Initially Four Casings Were Found All Matching Juarezs Gun

if Juarezs Story Were True There Should Have Been Six Sounds in the Initial Volley Two from the Attackers and Four from Him Instead Witnesses Heard Only Four the Initial Gunfire Was All Juarez

as David Duongs Attorneys Wrote in Their Reply Brief docket 162 the Available Evidence Suggested That in the Initial Round of Gunfire Co conspirator 1 Shot Four Times and the Supposed Assassin Not at All

you Dont Need a Ballistics Degree to See the Problem

the Neighborhood Told a Different Story Too a Neighbor Reported Seeing two Mexican Males Hitting Juarezs Car with a Brick Prior to the Shooting Police Found a Red Brick Near Juarezs Car Which Had a Smashed Window with Red Dust Consistent with the Brick Juarez Himself Told Officers He Saw an Individual Inside His Vehicle

neighbors Told Investigators This Was a High crime Area There Had Been Prior Shootings the Suspects Were Described As Local to the Neighborhood People Seen at a Nearby Liquor Store This Was Not a Sophisticated Assassination It Looked Like a Smash and grab Gone Sideways when the Homeowner Came out Firing

defense Counsel Put It This Way in the Reply Brief sa Haunolds Declaration Does Not Claim That He or Any of His Colleagues Have Ever Encountered a Case Where an Alleged Hit Man Who Was Lying in Wait Allowed His Target to Get into His House and Arm Himself Before Attempting to Lure the Target out by Loudly Breaking Car Windows Thereby Drawing the Attention of the Entire Neighborhood Who Could then Witness the Shooting

no Competent Assassin Breaks Car Windows with a Brick and Waits for the Target to Get Inside Grab a Gun and Come out Shooting if the Duong Family Sent Hit Men They Sent the Worst Ones in the History of Organized Crime Men Who Arrived Smashed a Car Window Let the Target Arm Himself Took Zero Shots when the Target Opened Fire Fled Allegedly Came Back Missed Every Single Shot and then Vanished Without a Trace

or It Was a Car Burglary and Juarez a Man Known for Embellishment Violence and Self interest Fired at the Burglars and then Told the Fbi They Were Assassins

the Shotspotter Problem

here is Where the Governments Timeline Becomes Evidently False

shotspotter the Acoustic Gunfire Detection System Used by Oakland Police Recorded the Shooting the Reports Documented Four Gunshots at 952 Pm and Nine Additional Shots 15 Minutes Later at 1007 Pm Not Six Initial Shots As Juarez Claimed Four

according to the Defense Motion the Oakland Police Department Received the Shotspotter Data on June 15 2024 One Day After Agent Haunold Submitted the Affidavit for the Residential Search Warrants

but the Warrants Did Not End on June 14 Five Days Later on June 20 the Fbi Obtained Rollover Warrants Additional Warrants Extending the Search Authority Those Rollover Affidavits Continued to Allege That Co conspirator 1 Had Fired Only in Self defense They Did Not Disclose the Shotspotter Data

the Government Admits in Its Opposition Brief docket 151 That the Shotspotter Data was Not Analyzed Until Several Weeks Later According to the Government the Fbi Did Not Determine That Juarez Likely Fired First Until August or September 2024 More Than Two Months After the Raids That Destroyed a Mayors Career

the Fbi Had Acoustic Data That Contradicted Its Star Witnesss Account of an Attempted Assassination Data That Arrived Before the Rollover Warrants Were Filed and Nobody Looked at It

the Defense Argues This is Not Exculpatory It is Evidence of Reckless Disregard You Have an Informant You Already Know is Motivated by Revenge You Have an Informant You Already Know is a Co conspirator in the Scheme Youre Investigating You Have an Informant Already Charged with Felony Fraud and when Data Arrives That Could Show He Lied About Being the Target of an Assassination Data Relevant to the Very Warrants Youre Seeking You Dont Look at It

in September 2024 Three Months After the Raids the Fbi Finally Re interviewed Juarez About the Shooting He Changed His Story He Now Said He Shot First After Someone Pointed a Gun at Him This Was a Different Account from What He Told Oakland Police on the Night of the Incident and Different from What the Fbi Told the Magistrate

the Governments Defense

in Its Opposition Brief the Government Offers Two Responses to the Shooting Problem

first It Says the Significance of the Evidence Was unclear at the Time That Four Initial Shots and Four 40 Caliber Casings in Juarezs Yard Didnt Necessarily Tell Haunold That Juarez Fired First

david Duongs Attorneys Had a Response to That in Fact the Significance is Unmistakable

and It Is Juarez Said the Attackers Shot Twice then He Shot Four Times Witnesses Heard Four Shots Total Casings from Juarezs Gun Accounted for All Four Either Juarez Was Lying or the Supposed Assassins Fired Silent Rounds

second the Government Argues the Shooting Was Included in the Affidavit Merely for context About Juarezs state of Mind and Potential Motives for Statements to Law Enforcement

the Defense Demolished This in Their Reply the Affidavit Didnt Present the Shooting As Context It Presented It As a Standalone Crime It Asserted Probable Cause That the Duongs Violated the Federal Witness tampering Statute Attempted Murder to Prevent Cooperation the Government Cannot Claim the Shooting Was a Cornerstone Allegation when Seeking the Warrant and then Recharacterize It As Background Context when Challenged

as the Defense Wrote this After the fact Characterization Cannot Be Squared with the Application Itself

why the Shooting Mattered

imagine You Are a Magistrate Judge You Receive a Warrant Application in a Bribery Case the Amounts Are Modest 0000 Split Between Campaign Mailers and Payments to a Mayors Boyfriend the Documentary Evidence Consists Largely of Text Messages Written by the Cooperating Witness Himself the Agent Tells You His Informant is Revenge motivated and Has a Criminal History

caption Id=attachment 261202 Align=aligncenter Width=300 Mario Roberto Juarez the Serial Fraudster Whose Word is Gold to the Fbicaption

now Add This Three Days After the Informant Started Cooperating Someone Tried to Murder Him the Agent Believes the Defendants Family Ordered the Hit

that Changes Everything a Bribery Case Becomes a Case Involving Potential Violence the Urgency to Search the Defendants Homes Escalates the Informants Credibility Paradoxically Increases if They Tried to Kill Him He Must Be Telling the Truth About Something Important

now Remove the Assassination Replace It with What Actually Happened a Car Burglary in a High crime Neighborhood Where the Informant Fired First

the Affidavit Reads Very Differently Instead of a Dangerous Cooperator Targeted for Death You Have a Man with a Pattern of Confrontation Exaggeration and Self serving Lies a Man Who Turned a Neighborhood Burglary into an Assassination Plot Because It Served His Narrative

the Magistrate Never Got to Make That Evaluation Agent Haunold Made It for Her

no Evidence the Duongs Knew

there is Another Detail the Government Has Never Addressed and the Defense Highlighted It in Their Reply

agent Haunold Told the Magistrate the Shooting Was Connected to the Case for Two Reasons It Was a targeted Attack and It Occurred Just Three Days After Juarezs First Meeting with the Fbi

the Timing Argument Implies That the Duongs or Someone Acting on Their Behalf Learned Juarez Was Cooperating and Moved to Silence Him but the Government Does Not Dispute That There Was No Evidence Anyone Other Than the Fbi Knew About Juarezs Cooperation at the Time of the Shooting

as the Defense Wrote the Government Does Not Dispute That Sa Haunold Had No Reason to Believe That the Duongs or Anyone Else Knew Co conspirator 1 Had Started Cooperating with Law Enforcement Shortly Before the Shooting

so the Fbis Theory Required Accepting Two Unsupported Propositions That the Shooting Was a Targeted Hit Despite Physical Evidence Suggesting a Car Burglary and That the Duongs Somehow Learned About Juarezs Secret Fbi Cooperation in Time to Organize an Assassination Within 72 Hours Despite No Evidence They Knew

agent Haunold Presented Both Propositions As Established Facts

march 5 the Reckoning

on March 5 2026 Judge Gonzalez Rogers will Decide Whether to Hold a Full Evidentiary Franks Hearing if She Does Agent Haunold Will Be Called to the Stand He Will Be Asked What He Knew About the Shooting Evidence Before He Submitted His Affidavit He Will Be Asked Why Shotspotter Data Wasnt Reviewed Before the Rollover Warrants Were Issued He Will Be Asked Why He Told a Magistrate That a Car Burglary Was an Assassination

caption Id=attachment 262878 Align=aligncenter Width=226 Judge Yvonne Gonzalez Rogerscaption

the Standard for a Franks Hearing is Not High the Defense Needs Only to Make a substantial Preliminary Showing That the Affidavit Contained Deliberate or Reckless Falsehoods They Do Not Need to Prove It by a Preponderance of the Evidence That Comes Later at the Hearing Itself

the Shooting Evidence Alone May Be Enough

if the Hearing is Granted and the Defense Prevails the June 2024 Search Warrants Could Be Voided the Evidence Seized in the Raids the Raids That Dominated Oakland Headlines Destroyed a Political Career and Preceded a Recall Election by Four Months Could Be Suppressed

and a Federal Bribery Case Built on the Word of a Serial Fraudster Who Bounced His Own Bribery Check Might Finally Be Seen for What It Is

the Fbi Raided a Mayors Home over a Car Burglary They Called an Assassination

at Their Peak These Entities Held Hundreds of Millions in Cash Reserves Pulled Approximately 0 Million Per Year in Royalty Payments from Kazakhstan Alone and Controlled Exploration Projects Spanning Multiple Continents the Family Pocketed Roughly 0 Million over Twenty three Years While Jack Did the Work

then They Fired Him

the Takeover

by 2014 Jack Grynbergs Behavior Was Changing He Was in His Eighties His Children Would Later Testify That He Had Become Erratic Claiming to Own a Wyoming Oil Well Containing Thirty Billion Barrels more Than the Entire Nations Reserves Telling the President of Botswana He Had Two Billion Dollars in a Local Bank Trying to Buy One Hundred Million Dollars in Generators for a Nigerian Power Plant That Did Not Exist a Geriatric Psychiatrist Would Later Testify That Jack Had Dementia by 2014 and Was Sending Bank Information to a Gmail Address He Believed Belonged to a Brazilian Princess Who Had Been Dead for a Decade

in September 2015 the Pricaspian Board Voted to Remove Jack As an Authorized Signatory on the Companys Bank Accounts in February 2016 the Board Removed Him As President and Appointed Rachel and Stephen As Co interim Ceos in March 2016 They Removed Him from the Board Entirely

jack Fought Back He Filed Suit in Texas Claiming His Children Were Violating a Lifetime Agreement the Case Was Moved to Colorado a Jury Found There Was No Oral Contract Granting Him Lifetime Control a Judge Ruled He Was Not Entitled to a Penny in Back Pay for the Decades He Spent Building the Empire His Children Now Owned

rachel Led the Fight She is Now Ceo of Rsm Production Corporation and the Registered Agent for Gadeco Royalties Llc She and Her Siblings Control the Entire Apparatus the Kazakhstan Royalties the Domestic Exploration Rights the Cash Reserves and the Litigation Portfolio That Jack Spent a Lifetime Assembling

jack Grynberg Was Placed in a Care Facility He Died on October 11 2021 at the Age of Eighty nine

his Attorney Said Jacks Children Without Having Made Any Contributions to the Companies Had Received Approximately One Billion Dollars That He Alone Had Earned the Familys Lawyer Said They Were relieved to Have This Unfortunate and Painful Litigation Behind Them and That They Had Acted to Protect the Companies and Jack Grynbergs Legacy

whether the Children Were Right to Take the Companies from a Man with Dementia is a Fair Question the Courts Said Yes Reasonable People Can Disagree About Whether the Courts Got It Right or Whether the Children Could Have Found a Way to Protect Both the Companies and Their Fathers Dignity but Jack Grynberg Put Those Companies in His Childrens Names He Created the Legal Structure They Used to Remove Him That is Not in Dispute

what is in Dispute or Rather What Has Never Been Discussed at All is What Happened to the Women

the Women

in April 2015 One Year Before Rachel and Her Siblings Formally Ousted Their Father Candice Dee Smith Was Working As Jack Grynbergs Personal Assistant

smith Claimed in a Douglas County Lawsuit That Jack Had Bought Her a 0000 Home in Parker Colorado Furnished It and Let Her Live There for Free with Her Then husband and Five Children then the Bill Came Due According to the Lawsuit Grynberg Ushered Her into His Office Bathroom One Day and Told Her It Was time for You to Start Repaying Me for the House

the Lawsuit Alleged She Was Coerced into Sexual Contact Thirty five Times over Several Months

the Frank Report Will Note What the Reader is Already Thinking Thirty five Times is Not One Moment of Coercion It is Not a Single Act of Force from Which a Victim Could Not Escape It is an Ongoing Arrangement over a Period of Months Smith Alleged Coercion and Coercion is Real a 0000 House and a Job Create Pressure That Should Not Be Minimized but the Allegation Also Raises Questions About the Line Between Coercion and Complicity That Smith Herself Would Have Had to Answer if the Case Went to Trial the Frank Report Does Not Know Whether It Did

smith Was Not the Only Woman to Make Allegations

maxine Yzaguirre Worked As a Receptionist at Grynberg Petroleum for Five Months in 2016 She Claimed Jack Gave Her Tasks Requiring Her to Bend over While He Stared That She Walked into His Office and Found Him in His Underwear on at Least Three Occasions That He Thrust Himself at Her and Asked if She Was Interested and That After She Rejected a Kiss He Reminded Her He Had Just Given Her a Bonus

roxanne Alvarez Maxines Sister Worked As a Temporary Assistant She Alleged Grynberg Took Her to His Home to Do Tasks While Staring Down Her Shirt on a Separate Occasion She Claimed He Lured Her into the Mens Locker Room at the Companys Denver Offices Kissed Her and Put His Hands Inside Her Bra She Pulled Away and Ran Alvarez Reported the Locker Room Incident to Police Grynberg Was Arrested in December 2016 and Charged with Felony Unlawful Sexual Contact the Denver Da Later Dropped the Charge Saying It Could Not Be Proven Beyond a Reasonable Doubt

alvarez Also Reported the Assault to Terence Burns the Companys Vice President According to the Lawsuit Burns Told Her to Stay Quiet and Not Put Their Jobs at Risk He Said Grynberg Had Done This Before

burns and Company Attorney Roger Jatco Were Named As Defendants for Allegedly Knowing About Jacks Conduct and Failing to Protect Employees

a Fourth Woman Suzanne Greene Did Not Join As a Plaintiff but Submitted a Sealed Affidavit She Said She Was Harassed in 1976 Just Weeks After Being Hired As Jacks Executive Secretary She Said He Asked Her to Show a Visiting Associate a Good Time then Later Came to Her Home Pinned Her to a Wall and Forcibly Kissed Her when She Pushed Him Off He Said but You Invited Me Over Greene Resigned in 1977 and Said She Did Not Go to Authorities Because She Did Not Think They Would Believe Her

the Allegations Span Forty Years the Pattern Described by Burns he Has Done Things Like This Before Suggests It Was Well Known Inside the Company

the Question

here is What We Know About the Timeline

rachel Grynberg and Her Siblings Began Their Legal Campaign to Remove Their Father in 2015 2016 Their Theory Was That Jack Was Mentally Declining Making Irrational Decisions and Putting the Familys Billion dollar Empire at Risk

during That Exact Same Period 2015 and 2016 Four Women Were Alleging That Jack Grynberg Was Using the Same Company As a Vehicle for Sexual Predation One Woman Said She Was Coerced into Sex Dozens of Times Another Was Allegedly Assaulted in a Locker Room a Company Executive Acknowledged the Pattern and Told a Victim to Keep Quiet

the Familys Lawsuit to Seize the Companies and the Womens Lawsuit Were Proceeding Simultaneously in the Same Metropolitan Area Covered by the Same Newspaper

what Did Rachel Do for Those Women What Did Any of the Grynberg Children Do

we Do Not Know

it is Possible That the Grynberg Family Quietly Settled the Womens Claims Ensured They Were Compensated and Required Confidentiality As a Condition if So That Would Be a Responsible Resolution and by Its Nature We Would Never Know About It

it is Also Possible That the Family Took the Money Took the Companies and Left Those Women to Fight One of Denvers Wealthiest Families Alone

the Frank Report Does Not Know Which of These is True No One in the Grynberg Family Has Ever Said a Word About Those Women Publicly Not Rachel Not Stephen Not Miriam in the Age of metoo a Billion dollar Family That Built Its Entire Legal Strategy Around the Argument That Their Patriarch Was Unfit Has Never Acknowledged the Women Who May Have Had the Most to Say About Just How Unfit He Was

maybe the Silence Means the Matter Was Handled Privately and Responsibly Maybe It Means Something Else

what We Are Looking For

the Frank Report Received Tips Alleging That Rachel Grynberg Has Engaged in a Pattern of Aggressive Litigation and Destruction of Business Relationships Since Taking Control of the Grynberg Empire We Reviewed the Materials Those Tipsters Provided Most of It Documented Jack Grynbergs Legendary Litigation History Not Rachels What We Were Not Given Was a Single Case Filed by Rachel Grynberg Against Any Third Party Since She Took Control Not One

that Does Not Mean Such Cases Do Not Exist the Grynberg Family Operates Behind a Wall of Sealed Records and Corporate Privacy but Tips Dressed Up As Jacks Old Court Filings Do Not Get the Job Done if People Have Been Harmed by Rachel Grynbergs Stewardship of These Companies the Evidence Needs to Be Specific Case Numbers Jurisdictions Names

we Are Specifically Seeking Information on Two Fronts

first the Disposition of the Sexual Harassment and Assault Lawsuit Filed by Smith Yzaguirre and Alvarez in Douglas County Was It Settled on What Terms Did the Grynberg Family Companies Participate Were Non disclosure Agreements Signed

second the Current Status of Terence Burns and Roger Jatco Once the Grynberg Children Took Control Burns and Jatco Became Their Employees Burns Was Accused Under Oath of Telling a Victim to Stay Quiet Jatco Was Accused of Knowing About the Pattern and Doing Nothing Did Rachel Fire Them Did She Keep Them the Answer Tells You Something About What Kind of Company She Chose to Run

jack Grynberg Built His Fortune by Fighting Companies That Were Bigger Than He Was His Daughter Inherited That Fortune by Fighting the Man Who Built It Whether the Women Her Father Allegedly Victimized Were Taken Care of or Thrown Away is a Question the Family Has Never Answered

we Invite Rachel Grynberg to Contact the Frank Report at Any Time with Her Perspective if She Took Care of Those Women She Should Say So if Confidentiality Agreements Prevent Her from Discussing the Terms a Simple Acknowledgment That Those Women Existed and That Their Experience Mattered Would Cost Nothing
Zachary Michael the Multi Instrumentalist Wows the Audience

Most recently, SoleTurn delivered a beautiful two-hour performance at the One Eyed Cat that was performed on an outdoor stage and was very well received by the folks on hand. Their crowd-pleasing music was even appealing to some special guests I invited, mostly my age, who found SoleTurn very good listening. And that’s a generation that rarely turns out for an outdoor show and were glad they did.
